Overview

Eichholtz products are sold through multiple channels including retailers trade showrooms interior designers and e-commerce resellers. To preserve brand integrity online and to support quality physical showrooms Eichholtz has unilaterally instituted this Internet Minimum Advertised Price iMAP Policy. iMAP is the price a retailer or e-commerce reseller advertises on the internet for any Eichholtz product. Eichholtz may modify this policy at any time.

This policy is unilateral and applies only to advertised prices displayed on the internet. Retailers and resellers remain free to set final sale prices for individual customers.

Core requirements

• Authorized retailers and e-commerce resellers may not advertise or sell Eichholtz products on the internet below the current iMAP.
• This policy applies to all Eichholtz products including items marketed under other names or white-labeled by a retailer or reseller.
• Retailers may invite direct pricing inquiries with language such as For pricing inquiries please call or email.
• Eichholtz will furnish the iMAP price list to approved partners and may update it periodically. Advertised prices must be updated within 14 calendar days of email notice.

Internet advertising and marketing channels covered

The iMAP policy applies to any publicly accessible internet location or message including

• Public website pages product listings and any page prior to checkout
• Click here for best price discount applied at checkout click to see price hover for price or similar devices that reveal below iMAP pricing
• Automated bounce back pricing emails preformatted email responses or forms that reveal price before an item is added to a cart
• Marketplaces ecommerce aggregators auction sites portals pop ups banners and similar services

Permitted exceptions

• Flash sales Eichholtz may authorize limited time events below iMAP. Authorization will be emailed with the items the allowable discount and valid dates. After the event pricing must revert to standard iMAP. Exceeding dates may forfeit eligibility for a future event.
• Condition based listings iMAP does not apply to clearly identified Open Box Showroom Sample or Warehouse Clearance items on the same page where a below iMAP price appears.

Examples of iMAP violations

• Using an outdated price list to calculate iMAP
• Any advertisement that implies or offers a price below iMAP including discounts coupons rebates or similar reductions that drop the advertised price below iMAP
• Any arrangement where a non authorized third party sells or offers products on behalf of a retailer without prior written consent
• Bundling that effectively discounts an Eichholtz product below iMAP
• Comparing MSRP to iMAP to imply a below iMAP percentage discount

Enforcement

Eichholtz unilaterally determines whether a violation has occurred. Attempts to circumvent the intent of this policy are considered violations. All notices are sent by email.

• First violation Notice with 24 hours to correct. Send proof of remediation with URL links.
• Second violation Notice with 24 hours to correct. Orders may be placed on hold until corrected. Proof of remediation required.
• Third violation Notice of termination. All open orders are cancelled new orders refused authorization to use Eichholtz photography or creative assets is revoked. Payment remains due for all shipped orders.

Eichholtz will not discuss one reseller’s compliance with another reseller. This policy and all enforcement communications are handled directly with the account involved.

Administration

• It is the responsibility of each retailer or e-commerce reseller to remain current with iMAP updates.
• This policy is effective immediately and remains in effect until further written notice from Eichholtz. It supersedes prior policies on the same subject.
• This policy concerns advertised prices only. All other terms and conditions remain in effect.
